Terms of Service and Warranty Liability Disclaimer
By engaging the services of the contractor, the client acknowledges and agrees to these terms of service and warranty liability disclaimer.
1. Services Provided
The service provider operates as a private, independent contractor and does not maintain insurance coverage. All services are offered on an "as-is", "as available", or "without warranty" basis.
2. No Implied Warranties
The service provider disclaims any implied warranties of quality, fitness for a particular purpose, or specific outcomes.
3. Service Risk
While the services are considered to involve minimal and limited risk, the client acknowledges that the use of all services is at their own discretion, risk, and liability.
4. Limitation of Liability
The contractor disclaims all liability for damages beyond the direct cost of services provided, including indirect, incidental, special, or consequential losses, to the maximum extent permitted by applicable law.
5. Warranty Disclaimer
The contractor makes no guarantees or warranties regarding the condition of any pre-existing components or systems that may be impacted by the services provided.
6. Client Responsibilities
The client is responsible for providing accurate information and ensuring that the services requested comply with applicable laws and regulations.
7. Limitation of Remedies
The client's exclusive remedy for any claim or dispute arising out of the services provided shall be the correction or re-performance of the services, or a refund of the fee paid for the specific services giving rise to the claim.
8. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the contractor operates, being the Province of Alberta, Canada, without regard to conflict-of-law principles that would apply another jurisdiction's laws.
9. Entire Agreement
This agreement constitutes the entire understanding between the client and the service provider and supersedes all prior agreements and understandings, whether written or oral.
10. Modification of Terms
The service provider reserves the right to modify these terms of service and warranty liability disclaimer at any time, with such modifications to take effect upon notice to the client.
